-Know Your Rights-

In the event that you meet with an ICE agent or the police, remember that you have the right to:

  • If they come to your house, DO NOT open the door. If ICE agents want to enter your home, they must have a warrant signed by a Judge. A deportation order is not valid for entering your house. Ask them to slip this order under your door or show it through the window. 
  • Keep silent
  • Don't sign anything
  • Report and record any abuse by ICE agents
  • You have the right to request an interpreter if you don't speak English

If you are detained or looking for someone in ICE custody:
 - If ICE detains you, you can call and inform your family or emergency contact about your immigration status or ICE detention. Tell your family and emergency contact if you have your alien registration number.

The Red Cards inform ICE officers that you don't wish to answer questions or sign any documents. They also notify ICE officers that they are not allowed to enter your home or search your things if they do not have a warrant signed by a judge. And if they do, they must pass it under the door. Carry a red card with you at all times.

Family Plan

We recommend doing this as soon as possible for any unexpected ICE detention.

Have a plan in place so that a trusted adult with immigration status who is not at risk of being detained or deported can care for your children if you can't. Make sure that the school and your children know who can and cannot pick them up from school and who will care for them.

Include: (Go to the Prevention Guide to see the form).

  • Emergency phone numbers
  • Important information about your emergency contacts
  • Affidavit or power of attorney to appoint another person to handle your finances, business, money, rent, and mortgage, who can make decisions and who can care for your children.
  • Prepare a file with important documents about your children (medical conditions, schools, passports, birth certificates, etc.).
  • Have the contact information for the nearest consulate of your country. Many consulates have an emergency phone number. MN Consulates 
  • Create a DOPA: A Delegation of Parental Authority (DOPA) is a document that lets someone take care of your children when you can’t.

For free immigration legal assistance, please call their client intake line at 1-800-223-1368 during the following intake hours to schedule an appointment. They do not give walk-in or drop-in appointments. 

If you don't get an answer when you call, leave a message with your contact information so they can follow up with you promptly.

  • Monday: 10 a.m. – 1 p.m.
  • Tuesday: 1 p.m. – 4 p.m.
  • Wednesday: 10 a.m. – 1 p.m.
  • Thursday: 3 p.m. – 6 p.m.

  • Current DACA holders
  • Applicants for U.S. Citizenship
  • Refugees and asylees who want to get their green card (residency)
  • Non-U.S. citizen children abandoned, abused, or neglected by their parents
  • Temporary Protected Status (TPS) applicants and current TPS holders
  • Non-U.S. citizen survivors of human trafficking
  • Non-U.S. citizen survivors of certain violent crimes
  • Non-U.S. citizen survivors of abuse or domestic violence
